Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the Dave Studio website and the professional design and art services we provide. By engaging our services or using our website, you agree to these Terms. Dave Studio is based in Sieradz, łódzkie, Poland.
2. Services
Dave Studio provides commercial art and graphic design services including, but not limited to: brand identity design, print and editorial design, motion graphics, illustration, digital campaigns and packaging design. The specific scope of each project is agreed upon in a separate project brief or contract.
3. Project Engagement
All projects begin with a signed proposal or written agreement
A deposit (typically 50%) is required before project commencement
The remaining balance is due upon project completion and before final file delivery
Timelines are estimated; delays caused by the client may affect the project schedule
4. Intellectual Property
Upon receipt of full payment, Dave Studio transfers the agreed usage rights for the final deliverables to the client. Dave Studio retains:
The right to display work in our portfolio (unless confidentiality is agreed)
Copyright in all preliminary concepts, drafts and unused designs
Ownership of original artwork, source files and working files unless explicitly included in the project agreement
5. Client Responsibilities
The client agrees to:
Provide accurate briefing, content and feedback in a timely manner
Ensure they have the rights to any materials supplied to Dave Studio
Review and approve deliverables within agreed timeframes
Not reproduce, distribute or modify work prior to full payment
6. Revisions
Each project includes a defined number of revision rounds as stated in the project proposal. Additional revisions beyond the agreed scope will be billed at our standard hourly rate.
7. Cancellation & Refunds
If the client cancels a project after commencement, the deposit is non-refundable
Work completed to the point of cancellation will be invoiced proportionally
Dave Studio reserves the right to terminate a project if the client is unresponsive for more than 30 days
8. Confidentiality
Both parties agree to keep confidential any proprietary business information disclosed during the course of the project. This obligation survives the termination of the service agreement.
9. Limitation of Liability
Dave Studio's liability is limited to the total fees paid for the specific project giving rise to the claim. We are not liable for any indirect, consequential or incidental damages arising from the use of our services or deliverables.
10. Governing Law
These Terms are governed by the laws of the Republic of Poland. Any disputes shall be subject to the jurisdiction of the courts in Sieradz, łódzkie, Poland.
11. Changes to These Terms
Dave Studio reserves the right to update these Terms at any time. Continued use of our website or services after changes constitute acceptance of the revised Terms.
